Application Of The Act

Name of the Society |

The name of the Society shall be “SPINAL CORD SOCIETY”
 |
| Membership |

Membership of SCS will be open to all individuals with professional
qualification, interest and activities in research, treatment or
rehabilitation of persons with spinal cord lesions.

| Categories Of Membership –
Admission & Qualification |

Full Members

Individuals, Doctors, medically qualified who are active and professionally
involved in the treatment and rehabilitation of persons with spinal cord
lesions, according to the objectives of SCS shall be eligible for election
to full membership of SCS.
Associate Member

Either medical students, Doctors in training with not more than five years
after qualification or person in an allied medical or paramedical profession
involved in the treatment and rehabilitation of persons with spinal cord
lesions i.e. psychologist etc. shall be eligible for election to Associate
membership of SCS.
Honorary Members

Persona of distinction in the field of research, prevention, education,
medical and surgical treatment, as well as in public life who have
contributes to advances in rehabilitation and social re-integration of
persons with spinal cord lesions, shall be eligible as honorary members of
SCS.
Emeritus Members

Past Presidents and other Officers can be elected as Emeritus Members of SCS
on nomination by the Apex Body.

| Subscription |

The rate of subscription for all the members shall be Rs. 300/- per annum
and admission fee of Rs. 200/-
 |
| Refusal |

The Governing Body of the society may refuse any person for the membership,
provided reasons for refusal shall be communicated to the persona in
writing.

Expulsion (Cessation) |

The Governing Body of the Society may expel member from the Society on the
following grounds:
- On his/her death.
- If the member fails to pay the timely subscription continuously for
three months from the due date of paying the subscription
- If the member works against the aims and objectives of the society.
- If the member tenders his/her resignation.
- If the member fails to attend three meetings of general body
continuously without intimation.
- The reasons of expulsion shall be communicated to the concerned member.
Every such expelled member shall have a right to appeal before the General
Body which may or may not be accepted.

Appeals & Re-Admission Of Members |

All the appeals for re-admission shall be referred to the General Body of
the Society. The decision of the General Body shall be final. The reason for
rejection shall be communicated to the member concerned. In case of member
expelled by the General Body as per Clause 6 of the Rules & Regulations, the
same can be re-admitted provided the member concerned pays all upto date
dues and assures in writing of no-reoccurrence reasons which made ground for
his/her expulsion/cessation from the Society. The decision of the General
Body shall be final.

Rights And Privileges Of Members |
 |
- All members of SCS will receive newsletters, as well as notices of all
meetings, courses, conferences and other activities of SCS.
- Full Members of SCS whose subscriptions are not in arrears shall in
addition, receive for their personal use such copies of the medical journal
of SCS as are published during the year and shall be entitled to receive the
notice to attend and vote at all General Body Meeting (s) of SCS.
- Associate Members whose subscription is not in arrears shall have full
privileges of membership, except that they shall be unable to vote the
Annual General Meeting and shall not receive a personal copy of the journal
of SCS.
- Associate Member shall receive on payment of an additional subscription
and for personal use, such copies of the Medical Journals of SCS as are
published during the year.
- Any member entitled to receive the journal of SCS who joins SCS during
the year shall receive all copies of journals as are published during the
year.
- Honorary Members shall be exempted from payment of the annual
subscription and shall have full privileges of membership except that they
shall be unable to vote at the Annual General Meeting and shall not receive
a personal copy of the Medical Journal of SCS.
- Senior members shall be exempted from payment of annual subscriptions
and shall have privilege of full membership except that they shall not
receive a personal copy of the Journal of SCS.
- Emeritus members shall be exempted from payment of Annual subscriptions
when they retire from active medical practice and shall retain the privilege
of full membership.
- Members who wish to change their membership category must apply in
writing to the Honorary Secretary.

| General Body |

There shall be a General Body of the Society consisting of all the members.
The meeting of the General Body shall be held after every one year with a
quorum of 10 member of 1/3rd members whichever is less. No quorum shall be
required in the adjourned meeting. An emergent meeting of the General Body
may also be summoned on the written request of 20 members, or 1/4th members
whichever is less with 21 days prior notice for such meeting. The notice
period of general body shall be ten days. The following business shall be
transacted in these meetings:
Powers and Duties of General Body:
- To prepare the annual programme and policies.
- To hold meeting once in a year.
- To elect members of Board of Governors and appointment of office
bearers.
- To ratify appointment to senior positions comprising of Director
General and Director Administration or any other senior appointment.
- To consider and approve any business put up by the Governing Body.
- To approve the annual accounts and budgets
- To appoint a qualified Auditor for auditing yearly account of the
Society.
- Amendment of aims and object of the Society and Amalgamation of the
Society.
- Resolution of the Society as Section 13 & 14 of the Societies
Registration Act, 1860.
- Amendment of Memorandum of Association of the Society.
- To discuss and to decide all such other matters and issues which are
directly or indirectly related to the affairs of the Society.

| Governing Body |

There shall be a Governing Body of the Society to look after and to manage
the day to day affairs of the Society. It shall consist of minimum 7 and
maximum 15 members including the office bearers. The meetings of the
Governing Body shall be held after every 3 months with the quorum of 3
members. No quorum shall be required in the adjourned meeting. An emergent
meeting of the General Body may also be summoned on the written request of 5
members by 10 day notice of the meeting. The notice period of the Governing
Body shall be 10 days. The following business shall be translated in these
meetings:
- To take necessary steps for the implementation of all the programmes
and policies drawn by the General Body within the programmes and objectives
of the society as illuminated in the Memorandum of Association.
- To pass the necessary expenditure to make the day to day requirements
of the Society.
- To take decision on applications for members.
- To appoint a Committee for the disposal of any business of the society
or for advice in any matter pertaining to the Society.
- To arrange, finance if required from other bank(s), institutions or
individuals on reasonable terms and conditions and the Governing Body as a
whole is liable for its return.
- To appoint, terminate, fix duties of any employee and look after their
welfare.
- To receive, to have custody of and to expand the funds of the Society
and manage the properties of the Society.
- To sure and defend all legal proceedings on behalf of the Society.
- To take all such other legal steps which may appear beneficial for the
smooth and better management of the society.

- Election
The Governing Body of the Society shall be elected for a terms of three
years in the General Body Meeting. The secret ballot system shall be the
mode of election. The newly elected Governing Body list should be attested
by three out going office bearers and it will be filed with Registrar of
Societies, Delhi.
- Terms of the Governing Body shall remain for three years after taking
over the charge.

Duties / Powers |

- President
- He/She shall preside over all the meetings of the General Body and
Governing Body.
- In case of tie of votes in any meetings he/she shall tender
his/her casting vote.
- He/She shall supervise work of other office bearers from time to
time.
- Vice President
- In the absence of the President, the Vice president shall enjoy all
the powers and duties which are entrusted to the president. He/She will
also assist the president in his/her work.
- Secretary
- He/She shall represent the Society in all public and private
offices.
- He/she shall undertake all types of correspondence on behalf of
the Society.
- He/She shall undertake all types of correspondence on behalf of
the Society.
- He/She shall convene the meetings of the General Body, Governing
Body and he/she shall also inform every member regarding time, date and
place of the meetings through a ten days earlier written notice.
- He/She has the right of signing any document related to the
Society
- Joint Secretary
- He/She shall assist the Secretary for his/her day to day duties.
- In the event of the Secretary, the Joint Secretary shall enjoy all
the powers and duties which are entrusted to the Secretary for performing
the duties of the Secretary.
- Treasurer
- He/She shall collect subscriptions, gifts, grants-in-aid and donations from
the members and the general public and he/she shall also be responsible for
keeping and maintenance of the true and correct accounts.
- Executive Members
- They shall assist in the day to day work of the Society as directed by the
president and Secretary.
- Filling up of Casual
Vacancies
- The governing shall have the power to fill up the causal vacancies by the
Resolution passed by the majority of votes by the Governing Body only and
General Body shall have the power to ratify the appointment of senior
positions as per Clause 9.04.

Financial Year |

The financial year of the society shall be from 1st April to 31st March
every year.

Source of Income and Utilization |

Subscription, donations, grants-in-aid and gifts from the members and the
general public shall be the source of income of the Society. All the income
of the Society shall be utilized towards the aims and objects of the
Society.

Audit of Accounts |

Yearly accounts of the society shall be audited, after closing the accounts,
by the Auditors appointed by the General body.

Bank Accounts Operation |

The fund of the society shall be kept in a Schedule Bank. The bank account
of the society shall be operated and signed by two Office Bearers out of the
Treasurer, the president/Vice-President or the Secretary/Jt. Secretary who
shall also be eligible to sign the negotiable instruments whenever asked for
by the Bank. The account shall be audited by a qualified auditor every year.

Annual
List of Managing / Governing Body (Section 4 of Act) |

Once in every year a list of the Office bearers and members of the Governing
Body of the Society shall be filed with the Registrar of Societies Delhi as
required under Section 4 of the Societies Registration Act, 1860.

Amendment (Section 12
& 12-A of the Act) |

Any amendment in the Memorandum or rules will be carried out in accordance
with procedure laid down under section 12 and 12 A of Societies Registration
Act, 1860.

Dissolution and Adjustment of Affairs (Section 13 & 14 of Act) |

If the Society to be dissolved, it shall be dissolved as per provision laid
down under section 13 and 14 of the societies Registration Act, 1860 as
applicable to the Union Territory of Delhi.

Legal Proceedings
(Section 6 of the Act) |

The Society may sure or be sued in the name of its President or Secretary in
terms of the provisions specified under Section 6 of the Act.

Application of the Act |

All the provisions under all the Sections of the societies Registration Act,
1860 as applicable to the union Territory of Delhi, shall apply to this
Society.
